We represent clients in federal and state courts and before numerous regulatory agencies throughout the Mid-Atlantic, Southeast, and Northeast regions of the country, and we have represented clients in other courts and agencies throughout the United States.

Because our emphasis is on employer representation, we know that meeting business objectives is our clients’ bottom-line concern.  We work closely with client human relations, benefits, and legal staff to develop a solid understanding of each company’s operations, issues, and labor- and employment-related policies.  We then craft customized solutions that enhance compliance with federal and state laws, minimize disputes with employees, avoid litigation when possible, and maximize strategic advantages should negotiation, dispute resolution, or litigation become necessary.

Although a large part of our labor and employment practice involves litigation and dispute resolution, we proactively shape human resource policies and procedures in union and non-union settings at the start of a client engagement.  Our fundamental goal is to avoid problems before they start, preventing small issues from becoming major disputes.  When disputes do arise, we vigorously advocate on behalf of our clients before courts and administrative agencies to achieve the most advantageous resolution attainable in trial or settlement.

Our overall practice encompasses over twenty separate areas of counseling and dispute resolution.  The legal services we provide include:

  • Defense of discrimination, harassment, civil rights, promotion, pay/wage, discipline, discharge, and other workplace claims against employers;
  • Human resource policies and procedures, including the development of handbooks and communication programs, wage and hour compliance standards, management training programs, and audits of program and policy effectiveness;
  • Compliance with and related investigations involving OFCCP, EEOC, DOL, OSHA, DHS, IRS, and other federal and state regulators;
  • Labor-management relations, including collective bargaining, NLRB and wage and hour compliance, plant closing, and layoff and labor antitrust issues;
  • Litigation and tactical advice on executive contracts, severance agreements, non-competition agreements, and trade secret protection;
  • Procurement of temporary and permanent visas for skilled, professional and managerial foreign national employees; and
  • Design, drafting, and administration of tax-qualified and nonqualified pension plans, executive compensation programs, health and welfare plans, fringe benefit plans, and cafeteria plans.

Miles & Stockbridge lawyers collaborate with general counsel, executives, and line managers to achieve effective business results.  We build long-term relationships founded on mutual trust and respect.  We understand how to handle the delicate and sensitive matters that investigations and complaints often bring, and we strive to avoid business disruptions.

Whether the issues involve traditional labor law or general workplace and employment issues, problem avoidance or dispute resolution, proactive counseling or crisis management in such situations as strikes and plant closings, our labor and employment lawyers  have the business acumen and experience to handle them—and can draw on the full resources of the firm for comprehensive solutions.
