Our secured creditor representation is grounded in our extensive Commercial Finance and Real Estate practice. Our lawyers are involved in transactions from the very start of the deal – negotiating and preparing the loan documentation that provides creditor protection in the event of insolvency or default.
When an obligor faces default, we counsel each client on important tactical decisions, including whether to restructure the loan or enforce, as early as possible in order to enhance the client’s potential to maximize value and recover its debt. We evaluate whether a reorganization or liquidation of the borrower is the course of action best suited to recover our client’s claim. Whether pre- or post- default, we are there to provide legal counsel to our clients in making educated business decisions concerning the appropriate course of recovery.
An important element of secured creditor representation is the flexibility our lawyers bring to their recovery strategies. We work with traditional and non-traditional lenders in all stages of a bankruptcy case and workout, and often represent clients that are a borrower’s existing lender, clients that lend to the debtor-in-possession, clients that provide refinancing outside of bankruptcy and clients that provide exit financing through a confirmed plan.
